The president and CEO of the National Association of Professional Employer Associations (NAPEO), Pat Cleary, issued the following statement on the introduction of the Save Local Business Act to re-establish a clear definition of joint employer:
"NAPEO applauds Chairwoman Virginia Foxx (R-NC) and Representatives Bradley Byrne (R-AL), Tim Walberg (R-MI), Lou Correa (D-CA) and Henry Cuellar (D-TX) for the introduction of the Save Local Business Act. This common sense, bipartisan piece of legislation provides legal clarity for the definition of a joint employer. When the NLRB issued its 2015
Browning Ferris decision expanding the definition of a joint employer, small businesses faced increased uncertainty, confusion, and unpredictable liability under numerous federal statutes. Fortunately, the legislation introduced today provides a clear and concise joint employer definition. With the legal clarity provided by this bill, small businesses, including many clients of NAPEO member companies, will be able to focus on what they do best: creating jobs.
